Senator Bill Hagerty (R-TN) sponsored S. 3451, a bill to include certain computer-related projects in the federal permitting program under title 41 of the Fixing America’s Surface Transportation (FAST) Act, known as FAST-41. The FAST-41 provisions restrict environmental review and limit public input opportunities, particularly for large projects, by curtailing the National Environmental Policy Act (NEPA) process. FAST-41 undercuts opportunities to incentivize climate-sensible alternatives for energy, mining, and infrastructure projects of more than $200 million. In effect, the bill places severe limits on government accountability and public access to the courts on the country’s largest infrastructure projects where full consideration of the socio-economic, environmental, and community impacts are most warranted. On July 29, the House approved S.3451 by a vote of 303-89 (House roll call vote 417). NO IS THE PRO-ENVIRONMENT VOTE. The president signed the Hagerty bill, S. 3451, into law on August 16.
