Expanding FAST-41 to further undercut environmental review
House Roll Call Vote 417
Issues: Environmental Justice, Lands/Forests, Water, Air, Clean Energy, Other

Senator Hagerty sponsored S. 3451, a bill to include certain computer-related projects in the Federal permitting program under title XLI of the FAST Act, and for other purposes. The FAST-41 provisions restrict environmental review and limit public input opportunities, particularly for large projects, under the National Environmental Policy Act (NEPA) process. FAST-41 undercuts opportunities to incentivize climate-sensible alternatives for energy, mining, and infrastructure projects of more than $200 million. In effect, the bill places severe limits on government accountability and public access to the courts on the country’s largest infrastructure projects where full consideration of the socio-economic, environmental, and community impacts are most warranted. On July 29, 2022, House approved S.3451 by a vote of 303-89 (House roll call vote 417). NO IS THE PRO-ENVIRONMENT VOTE.
