S. 1477. The vote is on the Culver motion to kill the Bumpers amendment, which would have reversed the normal legal presumption in the courts that federal regulations are valid. This would have shifted the burden of proof from the polluter to the regulatory agency. History has shown that regulations to control pollution and toxic substances are extremely difficult to enforce, and this amendment would have made enforcement even more difficult. The Carter Administration opposed the Bumpers amendment and supported the Culver motion to table it. September 7, 1979. Rejected 27-51. YES is the correct vote.
